Review Abandonment Process

- Customer contacts DSD - Abandonment
Coordinator provides abandonment handout1,
reviews abandonment application1, petition1, sketch1 and
associated documentation. If traffic mitigation required, proceed
to Step #2. If OK for submittal, proceed to Step 3.
- Contact Street Transportation Department,
Traffic Mitigation Section. Street staff will determine if additional
measures are necessary and submit a report (Step # 2a) to customer.
If not required, proceed to Step #3.
- Application submitted to Development Services
Department, Central Log in. Abandonment coordinator
reviews application and forwards copies to city departments and utility
companies for comments. Staff report developed outlining conditions for
approval of abandonment request. If public hearing required, proceed
to Step #4.
- Staff will determine if public hearing is
required, depending on the type of abandonment and issues found during
the development of the staff report. If request does not impact public
access, proceed to step #5b. Otherwise proceed to Step #5a

- The hearing is conducted and testimony
is given. The hearing officer renders a decision. The decision
may be an approval, approval with stipulations, continuance, or denial.
The
customer
or the aggrieved party may appeal1 the
decision to the city Council. If the decision results in a denial
and appeals
are not successful, the case is terminated.
- Staff develops letter of disposition outlining the stipulations
of abandonment.
- Customer must now begin addressing abandonment
stipulations per results of either the public hearing or letter of
disposition. Once all stipulations have been addressed, staff will
finish processing
of legal description and forward to City Council for final resolution.
- City Council either votes to approve,
deny or continue request for final approval and resolution.
- Once resolution is adopted, abandonment documents
are forwarded to Maricopa County for Recording. The County then determines
ownership and disperses property per original subdivision plat. Once
recorded, the abandonment documents are placed in City Clerk’s Office
who also forwards the resolution to abandonment coordinator. Abandonment
coordinator then closes out the project file and sends to City Clerk
for permanent storage. Abandonment completed.
