Request authorization to change the order of business to approve the consent agenda. Suspension of the rules to change the order of business of the formal City Council meeting is required by Rule 7(b) of the Rules of Council Proceeding.
The consent agenda is being added to the November 4, 2009 formal agenda due to the cancellation of the November 3, 2009 City Council policy session.

ORDINANCE S-36685 -
CITY MANAGER'S CONTRACT FOR FISCAL YEAR 2009-2010
Request to authorize an agreement between the new City Manager, David Cavazos, and the City concerning terms and conditions of employment.
The proposed ordinance provides the new City Manager with a base annual salary of $236,997.85. In accordance with City Council direction, the contract will also contain an ethics provision requiring the City Manager to act in compliance with the City's Ethics Policy. Any violation of this policy may be cause for termination. This salary is the same base salary of existing City Manager, Frank Fairbanks. The City's executive search consultant, Bob Murray, has advised the City that this salary is below the current market rate for city managers who work for cities of a size similar to the City of Phoenix. Given the difficult economic challenges facing the City, Mr. Cavazos is willing to accept this starting salary.
With respect to benefits, the proposed ordinance provides that the contract should contain the same benefits provided to Frank Fairbanks under his City Manager contract.
