This request is for a new Series 10 liquor license for a discount dollar store. This location was not previously licensed for liquor sales and does not have an interim permit. This location requires a Use Permit for packaged liquor sales within 300 feet of a residential zoning district. This location is not within 2,000 feet of a proposed light rail station.
The sixty-day limit for processing this application was Thursday, August 6, 2009.

The letter is from the Westwood Community Association. They are concerned with the location of the proposed establishment due to the area's crime rate, numerous transients, and number of existing liquor outlets.

Staff Recommendation - Staff recommends disapproval of this application based on Police Department, Finance Department, and Planning Department recommendations for disapproval, and a neighborhood protest.
The Police Department disapproval is based on concerns with possible hidden ownership, the applicant's lack of experience as an owner or manager of a business licensed for liquor sales, and the number of existing liquor licenses in the area.
The Finance Department disapproval is based on missing tax returns.
The Planning Department disapproval is based on the applicant's failure to obtain the required Use Permit.
Additionally, staff believes this business is inappropriate for the sale of spirituous liquor pursuant to A.R.S. Section 4-201(H). An inappropriate business is one that cannot clearly demonstrate that the sale of spirituous liquor is directly connected to its primary purpose and not merely incidental to its primary purpose. In this case, the primary purpose of a dollar store is to sell household products, not serve as an off-sale beer and wine establishment.
If denied, the applicant will continue operations without a liquor license and the previous owner will not resume ownership.
