AMEND ORDINANCE S-35573 TO ENTER INTO A LAND EXCHANGE BETWEEN THE USA AND THE CITY
Request the City Council to amend Ordinance S-35573 adopted October 15, 2008, which authorized executing the necessary documents to exchange easements and fee title with the United States of America (USA) through its Department of Interior, Bureau of Reclamation (BOR) for the purpose of relocating irrigation facilities needed for the current and future expansion of the 91st Avenue Wastewater Treatment Plant and to except the United States, its officers, employees, agents, and assigns from the requirements of Phoenix City Code Section 42-13 concerning indemnification and assumption of liability by the City of Phoenix.
The purpose of this amendment is to except Salt River Project (SRP) from the requirements of Phoenix City Code Section 42-13 concerning indemnification and assumption of liability by the City of Phoenix.
Financial Impact:
There is no financial impact associated with this exchange of land.
This bears the recommendation of the Water Services Director and the Deputy Finance Director.
