Impact Fee Ad Hoc Committee

 

I recommend the formation of an Impact Fee Ad Hoc Committee with the following charge:  The Impact Fee Ad Hoc Committee shall work with City staff to review the City’s proposed impact fees.  Such review will include the methodology used to set the fees; phasing; equivalent dwelling units (EDUs); components in the street, open space and park fees; and build-out versus some other time factor.  Through consensus, the Impact Fee Ad Hoc Committee shall bring forth written recommendations to the City Council by no later than November 26, 2008. This Ad Hoc Committee will sunset on December 15.

 

In addition, I request a written report from the committee after its first meeting with a recommendation regarding a timeline for adoption and how future state legislation may impact the adoption of proposed fees.

PROPOSED 27TH AVENUE AND VINEYARD ROAD II ANNEXATION

 

 

This report recommends the approval of the proposed annexation of 0.1212 acres located just north of the northwest corner of 27th Avenue and Harvest Grove Lane.

 

THE REQUEST:

 

 

This proposed annexation area is a portion of the area generally bounded by Vineyard Road on the north, the Maldonado Road alignment on the south, the 29th Avenue alignment on the west, and 27th Avenue on the east. 

The purpose of this annexation is to correct a legal description miscalculation from the 27th Avenue and Vineyard Road Annexation (Annexation #413), which excluded a .12 acre narrow strip of land at the eastern portion of subject parcels,
APN 105-88-018J and 105-88-018K.  This proposed annexation will incorporate the remaining County land so that all of the land within the subject parcels can obtain City services. 

The General Plan Land Use designation for the site is Residential 0-1 du/acre – Large Lot . The applicant is proposing a General Plan Amendment and associated rezoning case to develop multi-family units at 10 du/acre.  The annexation of the remaining land on the site increases the area of the site from 18.56 to 18.68 and the density from 185.6 units to 186.8 units.  Though the potential density that can be achieved on the parcels has increased, the actual use of the remaining .12 acres to be annexed will likely become dedicated right-of-way.  The annexation analysis is based on the addition of 1.2 units.

The city of Phoenix will control rezoning requests in this area to ensure conformance with the General Plan Land Use Map. The city of Phoenix will capture property tax, utility tax, state shared revenue, and impact fees.

 

 

Option B - Deny the request for annexation:

 

 

 

If annexed later, this site would have been developed under County zoning and development standards that may not be consistent with the General Plan, Land Use Map, zoning, and development standards.

 

 

RECOMMENDATION:

 

Located next to adjacent county lands, this annexation is supported by the General Plan, particularly the Land Use Element, Goal 10, Policy 2. This annexation is recommended for approval.
