Repayment Agreements

Repayment agreements are a form of contract between the City and developers that allow developers and land owners that install oversized water or wastewater facilities to recoup a portion of there initial costs when other developers tie into the infrastructure at a later date.   These agreements stipulate that once the developer has installed water or wastewater facilities, the City will collect a repayment amount from subsequent users of the oversized facilities before allowing them to connecting to the City’s water or wastewater system, which will be used to repay a portion of the construction costs to the initial developer.  

The repayment is based on the following:

  • Water = Based on linear feet (front feet) of main measured along the specified property frontage.
  • Sewer = Based on the acreage of the specified property or individuals in the benefiting area.

If impact fees have been paid, impact fee credits are given to the original developer who provides the oversized facilities only for the portion of the facilities that the initial developer actually funds once the repayment agreement is taken into consideration. The impact fee credits for the remainder of the facilities will go to the other developers that hook in to the oversized facilities and have to make payments to the initial developer. 

Repayment Agreements for water and sewer mains 12 inches in diameter and below will be initially processed by the Planning and Development Department (PDD), Water Services Counter, 200 W. Washington St., 2nd Floor, Phoenix, AZ 85003, telephone 602-262-6551.

Repayment Agreements for water and sewer mains larger than 12 inches in diameter, for wastewater lift stations, and for all mains located outside City limits will be initially processed by the Water Services Department (WSD), Infrastructure Record Services counter, 200 W. Washington St., 8th Floor, Phoenix, AZ 85003, telephone 602-495-5601.
