Pursuant to A.R.S. § 38.431.02, notice is hereby given to the members of the City Council and to the general public that the City Council will hold a meeting open to the public on Tuesday, April 21, 2009, at 2:00 P.M. located in the City Council Chambers, 200 West Jefferson, Phoenix, Arizona.  Council members may participate by telephone.  As indicated in the Agenda, the City Council may vote to go into Executive Session, which will not be open to the public, for the purpose of discussing those matters listed on the Agenda.

Action Taken:

Vice Mayor Simplot called the meeting to order at 2:12 p.m.  Council members DiCiccio, Baier, Neely, Williams and Nowakowski were present.  Mayor Gordon and Councilmember’s Mattox and Johnson were absent.

COUNCIL INFORMATION AND FOLLOW-UP REQUESTS.

 

This item is scheduled to give City Councilmember’s an opportunity to publicly request information or follow-up on issues of interest to the community.  If the information is available, staff will immediately provide it to the City Council member.  No decisions will be made or action taken.

 

Action Taken:

There were no information requests.

 

CONSENT AGENDA.

 

This item is scheduled to allow the City Council to act on the Mayor’s recommendations on the Consent Agenda.  The Consent Agenda has been publicly posted.

 

Action Item:

Councilwoman Baier moved approval of items in the Consent Agenda clarifying that item #2 will be open for public responses for 85 days.   Councilman DiCiccio seconded the motion, which passed unanimously.

 

CALL FOR AN EXECUTIVE SESSION.

 

A vote to call an Executive Session may be held.

 

Action Taken:

Councilwoman Neely moved that the Phoenix City Council, pursuant to Arizona Revised Statutes, Section 38-431.02.A, meet in Executive Session on Tuesday, April 28, 2009 at 1:00 p.m. and Tuesday, May 12, 2009 at 1:00 p.m. in the East Conference Room, 12th Floor of the Phoenix City Hall, 200 West Washington Street, Phoenix, Arizona.  Councilwoman Williams seconded the motion, which passed unanimously.

 

REPORTS AND BUDGET UPDATES BY THE CITY MANAGER.

 

This item is scheduled to allow the City Manager to report on changes in the City Council Agenda and provide brief informational reports on urgent issues.  The City Council may discuss these reports but no action will be taken.

CDBG AWARDS TO HONOR COMMUNITY PARTNERS AND SHOWCASE THEIR ACCOMPLISHMENTS

Action Taken:

Rick Naimark, Deputy City Manager, introduced the item stating that in recognition of National Community Development Week, the City of Phoenix celebrates its Community Development Block Grant (CDBG) program partners.  Mr. Naimark stated that CDBG funds are used to erect new infrastructure and establish and/or maintain some services. 

 

Jerome Miller, Neighborhood Services Director, stated that many thanks are given to program partners and City of Phoenix staff.  Mr. Miller congratulated Ernest Martinez, Management Assistant II in NSD, Chris Hallett, Deputy Neighborhood Services Director; and Barbara Bellamy, Grants Administrator for NSD, for a job well done in administering the Community Development Block Grant (CDBG) this year.  Mr. Miller stated that the City of Phoenix typically receives $15 to $20 million in CDBG funding; however during the past six years moderate cuts occurred resulting in $4 million less than expected.  Mr. Miller continued to say that under the recently passed 2009 economic stimulus bill the City will recover a $4.57 million allocation of CDBG funds, as well as $17 million in FY 2009-2010.

 

Chris Hallett, Deputy Neighborhood Services Director, stated that the City of Phoenix received one of the largest grants in the nation of $39.4 million designed to address home foreclosures.  Mr. Hallett stated that at this time along with Council, staff would like to recognize nine outstanding Community Development Block Grant program partners.

 

Mr. Miller thanked Council for their continued support of Neighborhood Services and the Community Development Block Grant program.

 

Vice Mayor Simplot presented the Lupe Sisneros Memorial Award to Lou Kislin, Senior Program Manager for HUD Community Planning and Development, for being a key player in many of the City’s housing, neighborhood, and commercial revitalization projects. 

 

Councilwoman Neely presented the Neighborhood Revitalization Award to the John C. Lincoln Health Network, and Desert Mission Neighborhood Renewal.  Cindy Hallman, Vice President; Joel McCabe, Director; Tracy Crouch, Housing Program Coordinator; and Jacqueline Valenzuela, Housing Program Representative, were present to accept the award.      

 

Councilwoman Baier presented the Disability Advocacy Award to the Valley of the Sun School and Habilitation Center.  Cletus Thiebeau, President/CEO; Barbara Handlong, Administrative Services Manager; and Katy White, Vice Chairman Board of Directors, were present to accept the award.

 

Councilwoman Nowakowski presented the Economic Development Award of Excellence to Geshwind Associates.  Diane Geshwind, owner, was present to accept the award.

 

Councilwoman Williams presented the Community Service Hero Award to Arizona Bridge to Independent Living.  Phil Pangrazio, Executive Director; Darrel Christenson, Director of Community Integration; and John Lamm, Rehabilitation Specialist, were present to accept the award.

 

Councilman DiCiccio presented the Housing Partner of the Year Award to Chicanos Por La Causa to the Corazon Substance Abuse Rehabilitation Center.  Arjelia Gomez, Chief Operating Officer, was present to accept the award.

 

Councilwoman Neely presented the Homeless Service Provider of the Year Award to Tumbleweed Center for Youth Development.  Dick Geasland, Executive Director, Ruta Lloyd, Program Manager for the Open Hand Program, and Rena McKenzie, Case Manager for the Open Hands Program, were present to accept the award.

 

Councilwoman Baier presented the Community Service Hero Award to the Arizona’s Children’s Association.  Marc Kellenberger, Vice President, and Phyllis Habib, Director of Golden Gate and West Valley Services, were present to accept the award.

 

Councilman Nowakowski presented the Community Partnership Award to Bloom Builders, LLC.  Jon Bloom, President/Owner; Pat Young, Project Superintendent/Owner; and Mike Jeffries, Project Manager, were present to accept the award.

 

Vice Mayor Simplot thanked staff and all of the community partners for their hard work and stated that CDBG would not have been possible without everyone’s participation.

STATE LEGISLATIVE UPDATE

This report seeks approval, guidance, and direction from the Mayor and Council on state legislation of interest to the City.

 

Action Taken:

Tom Remes, Government Relations, introduced the item stating that April 21, 2009 is the 100th day of the First Regular Session of the 49th Legislature.  Mr. Remes stated that at a Senate Appropriations Committee meeting on Thursday April 16, 2009 Senate President Bob Burns (R - Peoria) discussed a possible budget plan that will close the final $500 million gap without raising taxes or using more lottery funds.  He stated that the House is aware of a possible Senate budget proposal, however nothing has been made public as of yet.  Mr. Remes stated that there have been no bills heard on the Senate floor, though there is reason to believe that bills begin to be heard soon. 

 

Councilman DiCiccio inquired where specifically state lottery funds are directed. Mr. Remes stated that he would have to look into that in more detail and provide a reply at a later date.

 

Councilwoman Baier inquired if there had been a budget brought forth from both the State House and Senate.  Mr. Remes stated that though the House is aware of a Senate budget, it is not said to be a joint venture.

 

Councilman Nowakowski inquired how District 7 and others could be involved with HB 2551 which specifically addresses graffiti.  Mr. Remes stated that as more information regarding bills becomes available staff will be sure to pass that information along.

 

Councilwoman Williams inquired if all proposed bills will have to wait until the budget has passed before being discussed.  Mr. Remes stated that that was the original idea; however some bills will be included in the budget to save time.  Councilwoman Williams inquired if the Senate will hear any important bills now.  Mr. Remes stated that the legislature would like the Trial Budget to be adopted first.

 

Councilwoman Baier moved for approval of this item.  Councilwoman Williams seconded the motion which passed unanimously.

PHOENIX 2010 general plan UPDATE

This report provides information for the City Council regarding requirements set forth in the State Statutes regarding updates to municipal General Plans every 10 years.

 

Action Taken:

David Cavazos, Deputy City Manager, introduced the item stating that by law the City of Phoenix must complete a General Plan every ten years, and the last General Plan was ratified in 2002.  Mr. Cavazos stated that staff is currently preparing the next General Plan which must be adopted by March 12, 2012.

 

Debra Stark, Planning Department Director, introduced Carol Johnson who will serve as the General Plan Project Manager.

 

Carol Johnson, Planning Administrator, stated that the City of Phoenix has the opportunity to capitalize on the Green Phoenix Initiative as proposed by the Mayor and many ASU partners.  Ms. Johnson stated that opportunities are great during this time of extreme budget limitations and staff resources.  Ms. Johnson stated that there will be four main focal points of the 2012 General Plan, and the first will be Smart Location and Linkages of housing and jobs availabilities as a means to reduce dependency on automobiles.  Ms. Johnson also stated that though many of our new buildings will not have formal Leadership in Energy and Environmental Design (LEED) certification, all will be built to specific LEED standards.  Ms. Johnson stated that the second focus of the General Plan will be Neighborhood Pattern and Design as means to facilitate compact development, walkable streets, and a diverse use of City land.  Ms. Johnson stated that the third focus will be Green Construction and Technology as a means to reduce the heat island.  Ms. Johnson stated that under this idea on-site energy generation will be researched, discussed, and implemented.  Ms. Johnson stated that the final focus of the General Plan will be to ensure the proper usage of the ten standard corresponding General Plan elements such as: land use, circulation, bicycling, housing, growth area, open space, environmental planning, water resources, energy, public service, and facilities.  Ms. Johnson stated that pending City Council approval in July 2009, ASU will help staff gather public support for the General Plan.  Ms. Johnson stated that appointment of the resident advisory committee, which will be similar to the Executive Bond Committee, will be in August 2009; public education/visioning will take place from September 2009 to January 2010; overview of General Plan goals/policies will take place January 2010 to July 2010; and the Village Planning Committee review will be from August 2010 to October 2010.  Ms. Johnson concluded in saying that the public will have the opportunity to comment from October 2010 to January 2010; the Planning Commission will make its final recommendation in February 2011; the City Council will vote to adopt in March 2011; and the schedule and ratification elections will take place in September 2011.

 

Councilman Nowakowski inquired if staff could provide the Council with a previous presentation regarding this process.  Ms. Johnson stated that they would do that as soon as possible.

 

Councilwoman Williams stated that some districts are very disconnected from public transportation and would like to see a General Plan that incorporates more of the suburban areas and addresses the growing number of vacant properties throughout Phoenix.

 

Councilwoman Neely stated that economic development is an important issue and would like to see it more explicitly addressed in the next General Plan.  Councilwoman Neely stated that the public needs to be aware that the General Plan is what we want for the City; however deviations may occur if necessary.  Councilwoman Neely also stated that everyone needs to think outside of the box when it comes to innovation and the future of the City.

 

Councilman DiCiccio stated that there are many great opportunities and would like to see a focus on vacant properties in the City.  Councilman DiCiccio stated that if we do not address this issue soon, Phoenix will have a tremendous blight problem in the very near future. 

 

Councilwoman Baier stated that is would be helpful for staff to utilize the results of the retail analysis that was just conducted.  Councilwoman Baier stated that it would also be helpful for staff to study taxation policies as those rules will dictate what can go where.  Councilwoman Baier also stated that Councilman Mattox is interested in understanding what rules we have that may inadvertently hinder us from doing positive environmental work.

 

Councilman Nowakowski stated that the Census is scheduled to take place in 2010 and inquired if we would be able to use those numbers for the General Plan as redistricting may need to take place.  Ms. Johnson stated that Census information will not be available for a minimum of two years, and by that time it will be too late to use for this General Plan.  Frank Fairbanks, City Manager, stated that the Planning Department holds on to the Census data information and will use it accordingly where applicable.

City Council Announcements

City Council Policy Session

April 21, 2009

 

COUNCILMAN DICICCIO

Councilman DiCiccio announced a Block Watch party would be held on Saturday at 10th Avenue and Missouri Avenue from 12:00 – 3:00.  He encouraged residents to contact his office for more information.

 

Councilman DiCiccio also stated the ALEX committee would be meeting later in the day at the Pecos Community Center to discuss plans for the City budget. 

 

Councilman DiCiccio also noted an update on the door-to-door solicitation ordinance would be given at the April 28th meeting of the Public Safety and Veterans Subcommittee. 

 

COUNCILWOMAN BAIER

Councilwoman Baier congratulated participants on the success of this past Saturday’s Sunnyslope Art Walk.  She also thanked the City of Phoenix staff that assisted with Monday’s meeting in the Council Chambers of the United States Senate Committee on Homeland Security and Governmental Affairs.

 

Councilwoman Baier noted the Parks and Conservation Foundation charity golf tournament will be held on Saturday, with proceeds going to support the Phoenix Afterschool Center (PAC) program.

Councilwoman Neely reminded residents of her monthly breakfast, to be held this Friday at the Marriott at Desert Ridge. 

 

COUNCILWOMAN WILLIAMS

Councilwoman Williams reminded residents her monthly breakfast will be held April 24th at the Hometown Buffet located at 28th Avenue and Bell Road.
