On January 11, 2009 at 0126 hours, A woman and her 16-year old daughter heard someone making entry into their guesthouse directly behind their residence on E. Maryland Avenue.  They looked out and saw a subject inside the guesthouse and called police.  Officers Erickson, Yoho and Murphy made contact with the subject just as he was trying to walk away from house.  The subject was dressed entirely in black clothing at the time and was carrying a large steak knife.  The officers were able to detain him without incident and the victims positively identified him as the subject inside their guesthouse.

Since he was not in possession of any stolen property at the time, the officers originally only had probable cause to arrest him for felony trespassing.  Officer Erickson organized the investigation at the scene and interviewed the victims.  After he was transported to the station, Officer Yoho conducted a very thorough interview with the subject.  He eventually confessed to breaking into the house with the intention of raping the 16-year old daughter and then committing suicide with the knife that he had been carrying.  The subject lived nearby and the two teenagers were students at the same school.  He described in detail how he planned to commit the crime and his motivation for doing it.  The proximity of the guesthouse to the main residence would easily lead someone to believe it was all one building.  He was unable to follow through with his plan because he broke into the wrong structure and the timely response of the officers.  Once the new information about the subject’s intention was developed, Officers Murphy and Knight-Fogel assisted with the investigation.  Officer Murphy provided logistical support and established contact with the Violent Crimes Bureau.  Officer Knight-Fogel took photographs of the suspect and his unusual clothing.

I would like to commend all of the officers involved in this investigation.  Their quick response to the call led to the subject’s initial arrest, but it was their dedication to duty and cooperative effort that exposed the true nature of the crime.  With minimal effort, the officers would have been justified in booking him for trespassing.  However, the officers took the time and made the extra effort necessary to discover his true plan and motivation.  Their actions have taken a disturbed and dangerous young man off the streets.  The actions of these officers are in keeping with the highest standards and traditions of the Phoenix Police Department.

  1. Stay alert to those around you.
  2. Stay in groups.
  3. If you must be alone, walk with confidence.(Don’t be a victim).
  4. Avoid isolated areas.
  5. Stick to well-traveled streets.
  6. Don’t wear shoes or clothing that restrict your movements.
  7. Carry a purse close to your body and a wallet in a front or inside pocket.
  8. Carry only what you need.
